1. Introduction

Welcome to PunkerIcon. These Terms and Conditions govern your use of our AI icon generation platform, located at https://icon.punkerduck.com/. By accessing or using our service, you agree to these Terms.

If you do not agree with these Terms, please do not use our services.

2. Services

We provide AI-powered icon generation tools (“Services”). You may use our Services to generate icons for your personal or business use, subject to these Terms.

3. Accounts

To access some features, you may need to create an account. You agree to provide accurate information and keep your account secure.

You are responsible for all activities under your account.

4. Payments

Payments are processed through Paddle. By purchasing our services or subscriptions, you agree to pay all applicable fees as specified.

Pricing, payment terms, and subscription details are provided at checkout. We reserve the right to change prices with reasonable notice.

5. License and Usage Rights

We grant you a limited, non-exclusive, non-transferable license to use the icons generated for personal or commercial use.

You may:

• Use the generated icons in personal or commercial projects.
• Modify the icons as needed.

You may not:

• Resell the icons as standalone products.
• Claim that the icons were created manually by you without using our service.
• Use the service for unlawful purposes.

6. Intellectual Property

All underlying technology, algorithms, and website content (except for generated icons) are our property and protected by intellectual property laws.

7. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or use our Services in a harmful manner.

8. Limitation of Liability

PunkerIcon uses AI technology from OpenAI to generate icons. Please check your local copyright laws regarding the use of AI-generated images. By using our service, you agree that we are not responsible for how you use the generated images, or for any damages or losses caused by them.

Our total liability is limited to the amount you paid for the service, or $100 if no payment was made.

We are not liable for any indirect, incidental, or special damages, including loss of profits, data, or business, even if we were advised that such damages could happen. Some locations may not allow this limitation, so it may not apply to you.

9. Dispute Resolution

Before initiating formal legal action, you agree to try to resolve any disputes with us through informal negotiations. If unresolved, disputes will be settled by binding arbitration in accordance with applicable laws.

10. Third-Party Services

We use third-party services, including Paddle (for payments), OpenAI and Google Analytics (for analytics). By using our services, you agree to the privacy policies and terms of these third parties.

11. Modifications

We may update these Terms periodically. We will notify you of changes by posting the updated Terms on this page with a revised “Effective Date.” Continued use of the Services after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Republic of Turkiye, without regard to its conflict of law provisions.

13.Subscription and Token Usage
PunkerIcon operates on a monthly subscription model. Each month, you receive a set number of usage credits (tokens). These tokens are valid only within the current subscription period and do not roll over to the next month.
Unused tokens will expire at the end of each billing cycle and cannot be refunded or carried forward.

14. Refund Policy

Since our product is a digital service that provides instant access to AI-generated icon generation credits (tokens), we generally do not offer refunds once the service has been accessed.
However, we understand things happen — if you experience technical issues or believe you’ve been charged in error, please contact us at icon@punkerduck.com within 7 days of your purchase. We’ll be happy to review your request.
When Refunds May Be Issued:

• You were charged more than once for the same subscription.
• You were charged after canceling your subscription before the billing date.
• You encountered a technical problem that prevented you from using the service, and our support team couldn’t resolve it.

When Refunds Are Not Issued:

• You changed your mind after using the service or consuming icon generation tokens.
• You didn’t cancel before your renewal date.
• You didn’t use the service, but your subscription remained active.

All refunds are issued via our payment processor, Paddle, and may take several business days to appear in your account.

15. Contact

This website and service are operated by Yasin Çalışkan, a sole proprietor doing business as Punkericon. All business activities, including billing and customer support, are managed under this entity.
